CBS Atlanta has provided data which shows that drivers on Peachtree Industrial Boulevard may be more likely to get a traffic ticket while driving on the portion or the highway that cuts through Duluth than the portions which proceed through other municipalities.

The Duluth Police Department wrote 2,786 traffic citations on that road in 2010. That number is more than four other police departments combined.

Records show that on the same roadway during 2001, Chamblee police wrote 1,001 citations, Suwanee police issued 644 tickets, Doraville police wrote 416 and Norcross officers handed out the fewest coming in at 239 tickets.

Duluth police does patrol the longest stretch–6 miles–but there’s likely something more to it. Duluth police admit their department is considered aggressive traffic enforcers and that they are aggressive because they believe cracking down on mere traffic violations actually serves to lower the overall crime rate in their city.

The theory is that a criminal may choose another municipality to commit a serious crime if the criminal was concerned he was more likely to be stopped by the Duluth police for an equipment violation or speeding during or after committing the crime than he would be by police elsewhere.

A Metro Atlanta police department has equipped patrol cars with a new system that automatically formats and prints out traffic tickets.

Unfortunately, such systems are more subject to human error than the traditional manual way of filling out a traffic ticket.

Traffic tickets typically start with the motorist’s license identification number. In the past, if an officer made and error and was one digit off with respect to this number, the rest of the ticket–name, address, date of birth, license plate–could still serve to show who the driver was.

If the new automated system is fed an identification number that is one digit off it may automatically complete the entire traffic summons with someone else’s information.

The Decatur Police Deputy Police Chief Keith Lee recognizes that human errors are possible and stated that when such error are brought to the attention of the police they are rectified as soon as possible.

The danger for any individuals here is for a ticket to be issued in their name and handed to another driver who considers the mistake a lucky break. Recognizing that the ticket was issued to someone else, the driver is unlikely to take any action on the ticket. Eventually, the license of the individual named on the ticket would be suspended.

If anyone finds out that such a ticket has wrongfully been issued in their name, they would need to follow through with the procedures for contesting the ticket. Hopefully the issuing officer took good independent notes or has a good memory and will admit in court that an error was made.

People who previously paid a Dekalb County traffic ticket years ago are getting notices in the mail that money is due and they need to pay again. No one is sure what went wrong, but based on the number of people complaining about getting billed for an already settled matter, clearly something is off.

One woman detailed her experience–she was arrested during a routine car stop on an unrelated infraction when the officer’s search showed a failure to appear and handle the previously closed and paid for summons. Luckily, she had all her paperwork to prove this was clearly the county’s error.

Not everyone will be so fortunate. Many paid and won’t be able to prove it and the county is going to really have a tough time determining what is a legitimate overdue matter and what is merely an error.

This is exactly why people should hold on to their receipts and proof the matter was closed. You never know what may pop up in the future. Assume nothing when it comes to matters such as these.

Hundreds stood in long lines Tuesday waiting to pay old parking and traffic tickets before the DeKalb County amnesty program ends and prosecution of scofflaws, with warrants issued and interest charged, begins.

There is a backlog of approximately 500,000 cases and the courts insist that, while it will take a while, they will get through the entire backlog. Admittedly, the courts are short staffed and their computers out of date.

While those speaking on behalf of the courts claim it was a change in administration that has motivated the push to collect on old Dekalb County traffic violations and parking tickets, the individuals paying the tickets don’t see it that way.

Some feel it is related to the bad economy and that it is an easy way to generate revenue. Others think having to take a day off and wait in line to pay tickets which can be as small as $15 to be silly.

While many may complain, I have to ask: Why didn’t they pay the tickets when they were first issued? It’s hard to blame someone for trying to collect on an old debt.

DeKalb County is attempting to collect more than $70 million on traffic tickets that violators have ignored.

To encourage those who owe traffic ticket fines, April is amnesty month. Either pay the fine without added fees or lose your license.

Dekalb County, Georgia contains roughly 10 percent of the city of Atlanta (Fulton County contains the rest). Dekalb currently has about 500,000 outstanding tickets dating back to the 80′s. The bulk of them have accrued in the last 10 years.

Fail to show up by the end of the month and a warrant will be issued and your license suspended.

About 3400 of the hundreds of thousands of outstanding tickets have been resolved thus far.

If you have any questions about the amnesty, feel free to contact a Dekalb County traffic ticket attorney.
