Difference between supension and revocation

With a suspension, your license or privilege is taken away for a period of time.

With a revocation, your license or privilege is canceled altogether. You may be required to reapply for a driver license if you’ve been revoked.

Difference between driver license and driving privilege

The best way to illustrate is with an example.

Consider 2 people with the same legal problem. One has a California driver license. One has a New York driver license. They both were issued the same high speeding ticket in New York.

Both are found guilty of the New York speeding ticket and New York decides to suspend as punishment.

The person with the New York driver license will have his license suspended. New York has the power to suspend a New York driver license. Now, this person won’t have a valid license to use anywhere.

The person with the California driver license will only have his privilege to drive in New York suspended. New York doesn’t have the power to suspend a California driver license. New York can only suspend the person’s privilege to drive in New York. Now, this person can’t drive in New York but still has a valid California license to be used anywhere else except New York.

Difference between mandatory and discretionary suspensions and revocations

Some suspensions and revocations will be mandatory. For example, in New York if you are convicted of driving without insurance you will automatically be revoked for one year. When a punishment is mandatory it means there is nothing anyone can do to stop if from happening.

Some suspensions and revocations are discretionary. This means the judge or hearing officer or agency in question can use it’s own judgment to decide whether to suspend or revoke. When a punishment is discretionary you will usually have the chance to present arguments that discretion should be exercised in your favor.
